Terms and Conditions

The agreement between you and us when you use Digital HQ. Plain English where we can manage it.

About these terms

These terms apply when you use this website, the client dashboard or the Agent Hub, where AI agents work for you. “We” and “us” means Digital HQ, based in Bristol, UK. “You” means the person or business using the service. If you sign up for a business, you confirm you’re allowed to agree to these terms for it.

Bespoke project work (websites, integrations, development) is covered by the quote or agreement for that project. Where it differs from these terms, the project agreement wins.

How we handle personal data is set out in our Privacy Policy.

Your account

  • You must be 18 or over to create an account.
  • Keep your login details safe. You’re responsible for what happens under your account, including anything your team does in it.
  • Tell us straight away at hello@digitalhq.uk if you think someone else has got into your account.

The subscription

  • Price. The Agent Hub is a monthly subscription, at the price shown when you subscribe. You can create as many agents as you like.
  • Included usage. Each month includes an allowance of credits. Agents use credits as they work: the more an agent reads and writes, and the more powerful the AI model it runs on, the more credits a task uses. Your Billing page shows what you’ve used. Unused credits don’t roll over.
  • Extra usage. Go past the allowance and your agents keep working. Extra credits are charged at the rate shown when you subscribe and added to your next invoice.
  • Spending cap. To protect you from a surprise bill, each month has a cap on credits. If your agents reach it, they pause until the next month starts.
  • Payment. Stripe takes payment for us. The monthly price is charged in advance at the start of each month, and extra usage at the end of it. If a payment fails, Stripe will retry it for a short time; if it still can’t be taken, we may pause your agents until it is.
  • Price changes. We’ll give you at least 30 days’ notice by email before a price change applies to you. You can cancel before it does.

Cancelling

  • There’s no contract or minimum term. Cancel any time from your Billing page.
  • Your subscription stays active until the end of the month you’ve paid for, then stops. We don’t refund part months, and any extra usage up to that point is still charged.
  • If you’re subscribing as a consumer rather than a business, you can cancel within 14 days of first subscribing for a refund, less a proportionate amount for the service you’ve already used.

Using AI agents

Agents are powered by AI models, mainly from Anthropic. They are capable, but they can get things wrong: misread an email, misjudge a tone, or state something that isn’t true.

  • You approve what goes out. Emails, replies, pull requests and other actions that reach other people are only sent when someone on your team accepts them. Check them before you do.
  • You’re responsible for what you approve, in the same way as if you’d written it yourself.
  • Not professional advice. Don’t rely on an agent for legal, financial, medical or other professional advice without checking it with a qualified person.

What you can't use it for

You agree not to use Digital HQ, or have an agent, do any of these:

  • Anything unlawful, fraudulent or harmful.
  • Spam, bulk unsolicited messages, or contacting people who haven’t agreed to hear from you where the law requires it.
  • Pretending to be someone else, or hiding that a message came from an AI where you’re required to say so.
  • Harassing, threatening or discriminating against anyone.
  • Breaking the rules of a service you connect (such as Google, GitHub or Discord) or of Anthropic’s usage policies.
  • Trying to get around usage limits or security, reverse engineer the service, or access other customers’ data.

Connected services

When you connect a service such as Gmail, Google Calendar, GitHub or Discord, your use of it is also covered by that provider’s own terms. We aren’t responsible for those services, their availability, or changes they make that affect what an agent can do. You can disconnect any of them at any time.

Your content and ours

  • Yours stays yours. You own what you put in (messages, files, instructions, rules and notes) and what your agents produce for you. You give us permission to store and process it only to run the service for you.
  • Ours stays ours. The Digital HQ software, website and brand belong to us. You can use them while you have an account, but you don’t own them.
  • Feedback. If you send us ideas or suggestions, we can use them without owing you anything.

Availability and changes

We work hard to keep Digital HQ running, but we can’t promise it will always be available or free of errors. Some features, such as Gmail, are in beta and may change or be withdrawn. We may update the service over time; if a change takes away something important you pay for, we’ll tell you, and you can cancel.

Suspending or closing accounts

We may pause or close an account that breaks these terms, puts other people or the service at risk, or hasn’t paid. Where we can, we’ll tell you first and give you a chance to put it right. You can close your account at any time by emailing hello@digitalhq.uk.

Our liability

  • Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn’t allow us to limit.
  • We aren’t liable for loss of profit, revenue, business or data, or for any indirect or consequential loss.
  • We aren’t liable for anything an agent sends or does that you or your team approved.
  • Otherwise, our total liability to you in any 12 months is limited to what you paid us in those 12 months.
  • If you’re a consumer, these limits don’t affect your legal rights.

Changes to these terms

We may update these terms. We’ll change the date at the top, and email you at least 30 days before a change that matters takes effect. If you keep using Digital HQ after that, the new terms apply.

The law

These terms are governed by the law of England and Wales, and the courts of England and Wales can settle any dispute. If you’re a consumer living elsewhere in the UK, you can also bring a claim in your local courts.
